Kirstie has been a solicitor for over 20 years practising exclusively in Family Law. Kirstie is a Queensland Law Society Accredited Specialist in Family Law and a Nationally Accredited Mediator.

As a Mediator, her focus is on providing to the clients, a secure negotiation environment in which they are asked to make some important decisions for themselves. All clients are treated with respect and empathy. The fact that there is conflict is recognised.

Kirstie places high importance on the clients getting as best an understanding as they can of the mediation process so they do not come to mediation feeling intimidated by the prospects of what might happen at mediation.

What is Mediation?

Mediation is a form of negotiation where parties involved in a dispute are assisted by an independent third party to help them reach agreement.

Kirstie Day is an accredited family law specialist and nationally accredited mediator with over 20 years of experience in all aspects of family law.  Kirstie Day has particular expertise in complex financial and parenting matters.

What is the role of the mediator?

The Mediator will act fairly and impartially and assist the parties to explore and develop options for and, if possible, to achieve the expeditious resolution of the dispute by agreement between them.

Should I bring a lawyer to mediation?

The Mediator cannot give you legal advice so it can be useful to have your lawyer attend mediation.  It is not essential, however, to have a lawyer attend mediation with you.  Our mediator will conduct mediations with or without lawyers present.

Do I have to be in the same room as my former partner?

We offer shuttle style mediations at a venue agreed between the parties (where the mediator moves between the parties who remain in separate rooms if the parties are attending in person mediation) or mediation in an electronic format such as telephone, Microsoft Teams or Zoom.  Parties are welcome to participate in mediation in the same room by mutual agreement and will be accommodated in face to face and electronic formats.

Is the mediation confidential?

Save for some limited exceptions in relation to safety and risk, mediations are confidential.

How long does it take?

We offer half day and full day mediations.  A half day mediation is four hours.  A full day mediation is 9am to 5pm.  Additional hours can be accommodated, including travel outside of Brisbane, for an additional fee.

When is an appropriate time to mediate?

Whenever a dispute arises.  Mediation can assist parties to navigate interim issues and steer them on the pathway towards final agreement.  Many family law matters resolve on a final basis at mediation.  Mediation is a cost effective and useful tool to assist parties to reach agreement without the need to engage in protracted litigation.  Mediation can be productive when court proceedings are already on foot to narrow the issues or resolve them on a final basis prior to a hearing.
